Terms of Service

1. Acceptance of Terms

By accessing and using ROJA ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use our Platform. These Terms of Service are governed by the laws of Zimbabwe.

2. Definitions

• "ROJA" refers to our rental property platform and services
• "User" refers to any person who accesses or uses the Platform
• "Tenant" refers to users seeking rental properties
• "Landlord" refers to users listing properties for rent
• "Property" refers to any rental property listed on the Platform
• "Service" refers to all services provided through the Platform

3. Eligibility

To use ROJA, you must:

• Be at least 18 years of age
• Have the legal capacity to enter into binding contracts under Zimbabwean law
• Provide accurate and complete information during registration
• Maintain the security of your account credentials
• Comply with all applicable laws and regulations

4. User Accounts

4.1 Account Creation

You are responsible for maintaining the confidentiality of your account information and password. You agree to accept responsibility for all activities that occur under your account.

4.2 Account Security

You must immediately notify us of any unauthorized use of your account or any other breach of security. We are not liable for any loss or damage arising from your failure to comply with this section.

5. Property Listings

5.1 Landlord Obligations

Landlords agree to:

• Provide accurate and complete property information
• Ensure property availability matches listing details
• Comply with all applicable rental laws and regulations in Zimbabwe
• Respond promptly to tenant inquiries
• Maintain properties in habitable condition
• Obtain necessary permits and licenses

5.2 Prohibited Listings

You may not list properties that:

• Violate any laws or regulations
• Are fraudulent or misleading
• Infringe on intellectual property rights
• Contain discriminatory terms
• Are unsafe or uninhabitable

6. Rental Agreements

ROJA facilitates connections between tenants and landlords but is not a party to rental agreements. All rental agreements are entered into directly between tenants and landlords and are subject to:

• The terms agreed upon by both parties
• Applicable Zimbabwean rental laws, including the Rent Regulations Act
• Local municipal bylaws
• Any applicable consumer protection laws

We recommend that all parties seek legal advice before entering into rental agreements.

7. Fees and Payments

7.1 Service Fees

ROJA may charge fees for certain services, including but not limited to:

• Property listing fees
• Premium listing features
• Transaction processing fees

7.2 Payment Terms

All fees are stated in United States Dollars (USD) or Zimbabwean Dollars (ZWL) as applicable. Payments must be made through approved payment methods. Refunds are subject to our refund policy.

7.3 Taxes

You are responsible for any taxes, duties, or fees imposed by applicable law in connection with your use of the Platform.

8. Prohibited Activities

You agree not to:

• Use the Platform for any illegal purpose
• Post false, misleading, or fraudulent information
• Harass, abuse, or harm other users
• Violate any intellectual property rights
• Attempt to gain unauthorized access to the Platform
• Interfere with or disrupt the Platform's operation
• Use automated systems to access the Platform without permission
• Circumvent any security measures
• Discriminate based on race, religion, gender, or other protected characteristics

9. Intellectual Property

All content on the Platform, including text, graphics, logos, images, and software, is the property of ROJA or its content suppliers and is protected by Zimbabwean and international copyright laws.

You may not reproduce, distribute, modify, or create derivative works from any content without our express written permission.

10. Disclaimers and Limitation of Liability

10.1 Platform Availability

We strive to maintain Platform availability but do not guarantee uninterrupted or error-free access. The Platform is provided "as is" without warranties of any kind.

10.2 Property Information

We do not verify all property information provided by landlords. Users are responsible for verifying property details, conducting inspections, and making informed decisions.

10.3 Limitation of Liability

To the maximum extent permitted by Zimbabwean law, ROJA shall not be liable for:

• Any indirect, incidental, or consequential damages
• Loss of profits, data, or business opportunities
• Disputes between tenants and landlords
• Property condition or rental agreement issues
• Third-party actions or content

11. Dispute Resolution

11.1 Governing Law

These Terms of Service are governed by the laws of Zimbabwe. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of Zimbabwe.

11.2 Dispute Between Users

Disputes between tenants and landlords should be resolved directly between the parties. ROJA may provide dispute resolution assistance but is not obligated to do so and is not responsible for the outcome.

12. Termination

We reserve the right to terminate or suspend your account and access to the Platform at our sole discretion, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users, us, or third parties.

You may terminate your account at any time by contacting us. Upon termination, your right to use the Platform will immediately cease.

13. Changes to Terms

We reserve the right to modify these Terms of Service at any time. We will notify users of material changes by posting the updated terms on the Platform. Your continued use of the Platform after such modifications constitutes acceptance of the updated terms.
